Guidance Update in Light of the Employment Rights Act 2025
The Employment Rights Act 2025 is scheduled to come into force on
18 February 2026. This legislation introduces a number of significant changes that directly affect the statutory functions and responsibilities of the Certification Officer.
As a result, substantial portions of the existing guidance are currently undergoing review to ensure alignment with the updated legal framework. Consequently, work to revise and update the guidance is actively in progress; but has not yet been completed.
During this period of transition, users should be aware that some existing guidance may not fully reflect the requirements introduced by the new legislation. In circumstances where any inconsistency or contradiction arises between the current published guidance and the Employment Rights Act 2025, the provisions of the legislation will take precedence.
Individuals and organisations are therefore advised to refer to the legislation as the authoritative source.
