Double Jeopardy - Murder arrest

Logan Detectives in conjunction with the Homicide Investigation Unit have today charged a man in relation to a 2009 murder.

Detectives re-opened the investigation after they received fresh and compelling evidence in December 2022.

The arrest is the second time in Queensland that the Double Jeopardy legislation will be exercised. Application will be made to the Queensland Court of Appeal to apply for a previously acquitted person to be retried for the offence of murder.

Detective Inspector Chris Knight said this arrest illustrates the persistence of investigators to achieve justice for victims of crime and the importance of members of the public sharing information with police.

There are legal restrictions preventing the publication of information identifying a person who is the subject of an application to be retried under exception to double jeopardy provisions.

Media are reminded of their obligations under Chapter 68, section 678K of the Qld Criminal Code.

A contravention of a prohibition on publication under this section is punishable as contempt of the Supreme Court.

As such, no further information will be released by police under any circumstances.
