This action comes after the Australian Government's legislation to strengthen regulation of the early childhood education and care sector passed Parliament on 31 July 2025.
The department has continued to work with State and Territory Regulatory Authorities to identify services that have not met NQS relating to child health and safety over multiple years.
To date, over 50 services have a condition imposed.
The conditions of approval require relevant providers to achieve a 'Meeting NQS' rating within a set timeframe.
Details of conditions relating to 41 services have been published on the enforcement action register which will be updated with details of the additional services with conditions imposed in the coming weeks.
Providers and services that do not meet the standards within the required timeframe may be subject to compliance action.
The department has also imposed a condition on a large provider that prohibits the provider from establishing new services or acquiring existing services for a period of 12 months.
Providers and services can find information on the National Quality Framework (NQF) and NQS on the ACECQA website. This includes guidance on how to improve quality and safety.
We encourage providers and services to engage with their State and Territory Regulatory Authority to discuss their NQF rating.
