Ensuring footpath compliance in commercial areas

Mornington Peninsula Shire will be undertaking compliance inspections of all Peninsula businesses within shopping precincts in the coming months to ensure compliance with the Commercial Activities on Footpath Policy.

The Commercial Activity Zone is the trading area located outside the property where a business may use the footpath for commercial purposes.

Businesses must apply to have a permit to occupy the footpath to display goods, such as:

  • 'A' frames
  • tables and chairs
  • bulky goods
  • planter boxes.

These inspections are being undertaken to ensure compliance and safety to the general community.

The Shire is committed to facilitating a balance between the use of footpaths for commercial activities and the need to ensure there is continuous, safe and dignified access provided to all.

Businesses that are found to be not complying with the requirements of the Commercial Activities on Footpath Policy may be subject to enforcement action.
