Pengda Pty Ltd has been fined a total of $33,000 in the Local Court of NSW as a result of a prosecution by SafeWork NSW.
The proceedings arose from an incident on 25 May 2023, when a worker suffered serious injuries after falling approximately 3 metres through the roof of a metal storage shed onto a pile of rolled up carpets.
Pengda Pty Ltd failed to notify SafeWork NSW of the incident or preserve the incident site for an inspection.
Pengda Pty Ltd plead guilty to an offence under section 38(1) of the Work Health and Safety Act 2011 (WHS Act) for failing to notify SafeWork NSW of a notifiable incident immediately after becoming aware of the incident.
Pengda Pty Ltd also plead guilty to an offence under section 39(1) of the WHS Act for failing to preserve the site of a notifiable incident until a SafeWork NSW inspector attended the site or otherwise directed.
Pengda Pty Ltd have the right to appeal against their sentence.

SafeWork Commissioner Janet Schorer said:
"Falls from heights are a primary cause of traumatic injuries and fatalities at NSW workplaces.
"SafeWork NSW reminds all businesses of their duty to ensure their workers are protected when working with potential falling hazards.
"Businesses are responsible for notifying SafeWork NSW of any incidents that occur and must be held accountable if they fail to do so."
