Planning Proposal & Draft Development Control Plan Amendments - 9 Palaran Avenue, North Kellyville (3/2021/PLP)

A planning proposal for a portion of land at 9 Palaran Avenue, North Kellyville is currently on public exhibition. The planning proposal would facilitate subdivision of the land for 7 residential lots through the following amendments to State Environmental Planning Policy (Sydney Region Growth Centres) 2006:

  • Rezone the portion of land currently zoned E4 Environmental Living to R2 Low Density Residential;
  • Amend the minimum lot size from part 4,000m2 to part 600m2;
  • Insert a local provision that specifies a maximum cap of 7 dwellings on the portion of land currently zoned E4 Environmental Living; and
  • Identify the dwelling cap local provision as a development standard that cannot be varied as part of a future development application.

The proposed amendments seek to enable orderly development of the subject land as part of the broader redevelopment of 9 Palaran Avenue for a proposed 23-lot residential subdivision, with one residue lot and associated road network connections.

A draft amendment to the North Kellyville Precinct Development Control Plan (DCP) 2018 has also been prepared in association with the planning proposal to ensure that future subdivision does not result in the creation of battle-axe allotments and to ensure the proposed development outcome aligns with the planned local character and streetscape.

Council received a Gateway Determination for the planning proposal in July 2021 which enables the application to proceed to public exhibition. Delegation for making of the Local Environmental Plan has been issued to Council under the Gateway Determination.
