Police will continue to patrol local beaches, nearby bushland and walking tracks in the Tweed/Byron Local Area Command in response to community concerns about illegal nude bathing, lewd behaviour, and sexual acts, NSW Police say.
About 4pm on Friday (26 January 2018), officers attended Tyagarah Beach whilst conducting high visibility patrols of local beaches.
Police saw two naked men on the beach, engaged in a sexual act, about 400 metres outside the designated clothing optional area.
The two men, aged 27 and 57, were issued criminal infringement notices for offensive behaviour.
Officers will continue to enforce council regulations at any beach that is not a registered beach for nude bathing under Section 633 (nude bathing) of the Local Government Act. There are signs on the beach stating this fact.
Possible police action can include infringement notices for offensive behaviour, and if the practice continues, charges for wilful and obscene exposure are possible.
Police would also remind the nude bathing community that the only current legal nude bathing beach is located at Tyagarah beach. The clothes optional area of the beach is clearly signposted.
