Update on Rezoning of 98 Acacia Avenue Leeton to Private Recreation

Leeton Shire Council

Council resolved to submit the Planning Proposal to amend the Leeton Local Environmental Plan 2014 by rezoning Lot 742 DP 751745 from RE1 Public Recreation to RE2 Private Recreation to Parliamentary Counsel for opinion at its April Ordinary meeting.

Lot 742 DP 751745 is the site of the previous Leeton Golf Club Clubhouse building, which was demolished several years ago. The clubhouse building had consisted of a bar, restaurant and function rooms.

Council was granted ownership of this site by the previous owner, the Leeton Soldiers Club, following Council's agreement to manage and fund the operation of the golf course.

The site is currently zoned Public Recreation RE1 which permits the redevelopment as an entertainment facility, food and drink premises, function centre and recreation facility (indoor).

Council decided to rezone the site to RE2 Private Recreation to allow for additional land uses (such as visitor and tourist accommodation and a registered club) to maximise the potential of this site and ensure long-term sustainability.

At its October Ordinary Council meeting 2020, Council resolved to prepare and submit an amended Planning Proposal to NSW Planning, Industry and Environment seeking a Gateway Determination to amend the Leeton Local Environmental Plan 2014 by rezoning 98 Acacia Avenue from Public Recreation RE1 to Private Recreation RE2.

"Council submitted the planning proposal to NSW Planning, Industry and Environment and we received a Gateway Determination on 13 January 2021," said Council's Manager, Planning Building and Health, Mr Francois Van Der Berg.

"The gateway to proceed was subject to conditions, all of which have been satisfied by Council.

"Council publicly exhibited the planning proposal from 12 February 2021 to 12 March 2021 and no objections were received," said Mr Van der Berg.

Council also resolved to submit the Planning Proposal to the Minister for Planning and Public Open Spaces to finalise and notify the amendment on the legislative website at its April Ordinary meeting.
