At its meeting on 9 December 2025, Council resolved to adopt draft amendments to Part B Section 8 - Shop Top Housing and Mixed Use Development, Part C Section 1 - Parking and other sections of The Hills Development Control Plan 2012 (DCP 2012) to ensure that the built form of shop top housing and mixed use development in the R4 High Density Residential zone is capable of supporting active uses and enabling street activation.
The amendments are summarised below:
- New objective for site planning that encourages small scale ground level active uses and street frontages in high density residential environments, enhancing neighbourhood walkability and vibrancy.
- New development controls for building and ceiling heights, public domain elements, active street frontages, materials and finishes, vehicular and pedestrian access and circulation, building entries, delivery and services and other controls.
- New control that enables parking provision for shops, business premises or restaurants or cafes in the R4 High Density Residential zone as part of shop top housing and mixed use developments to be assessed on merit.
- Note to be included in DCP sections which apply to certain land zoned R4 High Density Residential to ensure that future developments which incorporate non-residential uses refer to Part B Section D - Shop Top Housing and Mixed Use Development of DCP 2012.
The amendments to the DCP will come into force on the date that the associated planning proposal (9/2025/PLP) is notified on the NSW Legislation Website.
