Peninsula Building Projects Pty Ltd and its director, Clancy John (CJ) Fulton, are now permanently prohibited from carrying out, establishing or promoting any building business in Victoria. The court order also prevents them from quoting on work, entering into contracts, issuing invoices, accepting payments or promoting themselves as builders.
CJ Fulton is further banned from representing himself as a registered building practitioner. The injunction does, however, allow him to work as a carpenter in limited circumstances – under the supervision and responsibility of a registered builder
The permanent orders follow an interim injunction granted in December 2024, after the VBA presented evidence that Fulton had misused another builder's registration and taken deposits well above legal limits.
A statement provided to the court detailed how one consumer handed over $100,000 to renovate a master bedroom and ensuite with the builder leaving after demolition and failing to complete the work.
The VBA believes up to 100 consumers may have been affected by the company, which operated out of Rosebud and advertised services including home renovations, kitchen and bathroom upgrades, and new builds.
Failure to comply with the court orders could result in jail time for Fulton.
VBA Commissioner and Chief Executive Officer Anna Cronin said those who choose to ignore building regulations should take note.
