Fair Work Commission
We are proposing a number of changes to the Fair Work Commission Rules 2024. These changes are detailed in the Exposure Draft of the proposed Fair Work Commission Amendment (2026 Measures No. 1) Rules 2026.The proposed changes would:
- correct minor errors and omissions and update various references
- make some existing rules clearer
- make new rules and change existing rules to support the types of applications and notices that were introduced by the Closing Loopholes legislation
- provide for applications to be made online in MyFWC
- provide for documents to be served electronically, using links to the documents
- require jurisdictional objections to be included in responses to general protections or unfair dismissal applications, and
- require enterprise agreement applications to include a digital copy of the agreement in a specified format.
The General Manager recently published a statement about upcoming changes to our systems and processes. This included the need for rule changes to support the delivery of several projects. These proposed changes would support the implementation of the Agreement Checklist Assistant. This is a tool to support our staff who triage agreement approval applications.
