EPA Charges for Alleged Illegal Diamond Creek Waste

A Diamond Creek man will face Heidelberg Magistrates Court on multiple charges bought by EPA Victoria over alleged illegal acceptance of construction and demolition waste.

Joseph Chetcuti is the owner of a property on Black Gully Rd, Diamond Creek. EPA will allege Mr Chetcuti, on multiple occasions, accepted construction and demolition waste as well as soil containing construction and demolition waste, without the appropriate authority to do so.

EPA will also allege that Mr Chetcuti has failed to comply with a notice requiring him to cease accepting, classify and clean up the wastes.

"Construction and demolition waste poses an unacceptable risk to the environment if not disposed of appropriately and must go to facilities permitted to accept. It," explained EPA North Metropolitan Regional Manager Chloe Bernett.

"We will continue to work with Nillumbik Shire Council on this case, monitor the site of the alleged offence, and take further legal action if needed to keep the community safe."

Mr Chetcuti's case is scheduled for 29 October 2025.
