EPA prosecutes Bingo company over offensive odours in western Sydney

NSW EPA

The NSW Environment Protection Authority (EPA) is prosecuting Dial-A-Dump (EC) Pty Ltd, a subsidiary of Bingo Industries Limited, after receiving more than 800 complaints from residents in Sydney's west in Autumn last year, about offensive rotten egg gas odours allegedly coming from the company's landfill operation.

The EPA will allege that between March and June 2021, Dial-A-Dump committed an offence under section 129 of the Protection of the Environment Operations Act 1997, causing the emission of offensive odour - a rotten egg gas smell - from its premises.

The EPA claims the waste company failed to have adequate controls in place to collect landfill gas and treat it to remove odours.

Executive Director Regulatory Operations Stephen Beaman said the EPA would always fight to protect the community and the environment.

"Getting to this point requires considerable effort by our investigators to collect evidence for a prosecution," Mr Beaman said

"But given the significant impact on the community, it is important that we hold this Bingo company to account.

The offence carries a maximum penalty for a corporation of $1,000,000. A hearing date is yet to be set.

The EPA will continue to conduct regular inspections, odour surveys and air monitoring to ensure that Bingo minimises the risk of offensive odours impacting the local community.

Prosecutions are one of the tools the EPA uses to achieve the best environmental or human health outcomes. Our regulatory approach includes a wide variety of options.
