Folau case headed for Federal Court

A senior researcher at the University of Sydney Business School says the dispute between Rugby star Israel Folau and Rugby Australia may still have a long way to run, despite today's conciliation hearing before Fair Work.

“A settlement, if any, won't occur until the parties approach the Federal Court for a hearing,” said Giuseppe Carabetta, a Senior Lecturer in Employment Law and sports law specialist.  “They are unlikely to agree to arbitration if there's no mediated outcome today.”

“Without any settlement between the parties, we are likely headed to the Federal Court, where it will be treated as an employment, code of conduct dispute,” he said.

“The case may well have a very long way to run,” he concluded.
