Andrew George from Doogue + George Lawyers representing John Setka has confirmed proceedings have been filed today and issued by the Supreme Court.
Mr Setka is seeking that the courts declare the Labor Party must deal with him in accordance with the rules of the party.
Mr Setka said Albanese's public statement confirming he will be expelled from the Labor Party has denied him due process and justice and he should be treated as any other party member.
