Legislation in response to NZYQ high court decision

In response to the recent High Court decision that the Australian Government strongly opposed, today the Australian Parliament has passed the Migration Amendment (Bridging Visa Conditions) Bill 2023. 

The expeditious passage of this legislation through the House of Representatives and Senate was necessary in order to strengthen visa conditions and impose criminal penalties where needed to keep Australians safe. 

Community safety remains the utmost priority of the Government following the decision of the High Court in NZYQ v. Minister for Immigration, Citizenship and Multicultural Affairs & Anor.

We note that the full implications will not be clear until the High Court has provided written reasons for their judgement, which means further legislation may be required once that judgement has been considered.
