EPA Victoria has taken further action over alleged acceptance of industrial waste without the appropriate permissions at two Diamond Creek properties.
EPA has already taken action with Joseph Chetcuti, owner of one of the Black Gully Rd, sites, to face Heidelberg Magistrates Court on 29 October, on multiple charges involving alleged illegal acceptance of industrial waste.
EPA will allege Joseph Chetcuti, on multiple occasions, accepted construction and demolition waste as well as soil containing construction and demolition waste, without the appropriate authority to do so. EPA will also allege that Mr Chetcuti has failed to comply with a notice requiring him to cease accepting, classify and clean up the wastes.
EPA has also issued a notice to Diamond Gully Group Pty Ltd, the owner of a second Black Gully Rd site across the road from Joseph Chetcuti's property, to clean up industrial waste where illegal dumping activities have occurred.
EPA continues to investigate and monitor activities on both sites and will undertake further enforcement actions as appropriate.
"EPA will not allow the inappropriate disposal of industrial waste. It is a risk to the environment and the community and we will use all our powers to hold to account those responsible," said EPA North Metropolitan Regional Manager Chloe Bernett.
"We will continue to work with other authorities involved in the management of this case to monitor the sites of the alleged offences, and take further legal action if needed to keep the community safe."
