Stats NZ Adds Judicial Data to IDI After Privacy Review

This supplementary privacy impact assessment (PIA) addresses privacy considerations specific to judicial initiatives data integration into the Integrated Data Infrastructure (IDI). It should be read alongside the overarching Privacy impact assessment for the Integrated Data Service (PIA for IDS), which provides a comprehensive assessment of privacy and related risks. This document focuses only on aspects unique to this data ingestion that are not covered in the PIA for IDS.

Summary

Stats NZ collects the judicial initiatives data from the Ministry of Justice (MoJ) by agreement under an Approved information sharing agreement for Sharing Permitted Information with Stats NZ and authorisation by the Principal Youth Court Judge and the Chief District Court Judge, for the purpose of official statistics and research.

After collection, Stats NZ integrates the judicial initiatives data into the Integrated Data Infrastructure (IDI). Once integrated, Stats NZ governs access to the data for research purposes according to Part 5 of the Data and Statistics Act 2022.

The data contains information about charges finalised by the criminal courts since 1992 that were involved in a judicial initiative. The Ministry of Justice support the judiciary to operate the courts. Part of operating courts include supporting judicial initiatives. These initiatives are targeted, court-led programmes or approaches designed to improve justice outcomes by addressing specific needs, behaviours, or systemic issues through innovative, culturally responsive, or therapeutic methods - often in collaboration with communities, agencies, and service providers.

Charges that are still active in court are not included. Each charge includes the judicial initiative it was involved in along with the entry and exit dates, and exit type (where applicable) for the individual associated with the charge.

The data has been collected from, or contains information about, approximately 10,000 individuals.

Stats NZ collects the data two times a year.

In future, if Stats NZ wishes to access and use the data outside of the Integrated Data Service, Stats NZ must complete a separate PIA.
