Surveyors Required to Record Accurate Builder Details

Building surveyors must identify and record the correct builder's name and registration on all documentation – failure to do so can undermine enforcement action and consumer rights.

The Building and Plumbing Commission (BPC) is concerned to learn that some building surveyors are recording the incorrect entity in documentation, including:

  • permits listing the personal details or registration number of an individual builder, instead of the company name recorded on the contract
  • regulatory instrument service details (e.g. Direction to Fix) not matching the nominated registered building practitioner name and registration on the permit.

Where there is a major domestic building contract, the name of the builder on the permit must be identical to the party named on the contract (see s24B(4) of the Building Act 1993) and the Domestic Building Insurance policy. Additionally, for Directions to Fix or section 33 notifications made to the BPC, building surveyors must ensure the builder's details, including name and registration number, are correct and match the permit.

Overall, building surveyors must make sure builder details (name and registration number) also match across the contract, insurance document and your enforcement documents, and that personal and company registration details are used accurately and consistently.
