The BPC has immediately suspended Unik Constructions Pty Ltd after inspectors found a record number of defects at a site under construction in Carrum Downs.
The public interest suspension on 206 grounds applies to both the company's domestic and commercial building registrations and the personal domestic and commercial registrations of its nominee director Pratheepan Saravanapavan.
The suspension is in place pending a show cause process and notice which proposes the cancellation and disqualification of all four registrations and a fine totalling $230,000.
Unik Constructions has failed to fully comply with BPC directions to fix defective work at the Carrum Downs site and at other sites under construction in Mitcham, Bayswater, Nunawading, and Croydon.
The regulator has also issued 19 rectification notices for non-compliant plumbing work across these 5 sites.
At the Carrum Downs site, inspectors identified 70 building defects on just one of the 7 townhouses under construction after a thorough inspection over several days.
The BPC also inspected the other townhouses to confirm the defects are common throughout the building project meaning the builder is potentially responsible for as many as 500 defects at that site.
The litany of defects includes several that pose serious safety risks with deficiencies in the fire wall separation framing and other structural issues.
The show cause notice also outlines how Saravanapavan provided false and misleading termite protection work certificates to relevant building surveyors on more than 60 occasions.
In May this year, the BPC filed criminal charges against the same company and nominee director over the construction of a four-bedroom unit in Boronia.
Plumber Daniel King was also fined more than $12,000 for his work on the property following a complaint from the home owner last year that his work had contributed to mould issues and a rat infestation.
The BPC's only ability to act against the builder, with its current powers, is through legal proceedings as the Boronia unit was occupied when the complaint came in.
Next year, the BPC will have a new post occupancy rectification order power designed to get buildings fixed and save consumers the time, stress, and money of dealing with problems on their own.
