VCAT Hearing Update: Riddell Road, Sunbury

Following VCAT hearings on 11 and 13 March regarding enforcement action at 370A and 430 Riddell Road in Sunbury, VCAT has issued a series of orders.

These orders do not bring the matter to a close but outline specific steps that must be followed by the owner/operator. If these requirements are not met, the case will return to VCAT for a contested hearing in November 2025.

Importantly, the owner/operator must stop all works on the site and submit planning applications to Council for both the works already carried out and any future works they intend to undertake. No further work can happen on the land without Council approval.

These planning applications will go through the usual process, including public notification and the opportunity for community feedback through the advertising period.

The orders also require the preparation of an updated Erosion Management Plan to satisfy all parties of the safety and appropriateness of the significant earthworks conducted to date and any proposed future work.

In the event the landowner does not comply with these orders, or advance their planning applications appropriately, Council can request that the contested hearing be brought forward to an earlier date.
