Working From Home - Clerks Award Decision Issued

Fair Work Commission

A Full Bench of the Fair Work Commission has today issued its decision in the Working from home - Clerks - Private Sector Award 2020 major case (AM2024/34).

On 29 August 2024, the Commission commenced a new matter on its own initiative to develop a working from home term in the Clerks - Private Sector Award 2020 (Clerks Award). The matter was foreshadowed in the Final Report of the Modern Awards Review 2023-24.

A Full Bench comprising Justice Hatcher, Deputy President O'Neill and Commissioner McKinnon has decided to change the Clerks Award to include a working from home provision. A draft determination containing the proposed provision has been published for comment.

Next steps

Interested parties are invited to make submissions on the draft determination by 5 pm (AEST) on Thursday 17 September 2026.
