The provider was penalised for inadequate supervision of a child and failing to ensure that every reasonable precaution is taken to protect children from harm and hazards likely to cause injury.
Amity Early Learning Pty Ltd penalised for inadequate supervision, failure to protect a child from a hazard likely to cause injury and failing to ensure a staff member qualified in first aid was present.
The approved provider, Amity Early Learning Pty Ltd, which operates the service, Kids Academy Early Learning Centre and OSHC, was ordered to pay a combined penalty of $36,000 for contravening sections 165(1) and 167(1) of the Education and Care Services National Law (WA) Act 2012 for the offences of inadequate supervision of a child and failing to ensure that every reasonable precaution is taken to protect children from harm and hazards likely to cause injury.
Additionally, Amity Early Learning Pty Ltd breached regulation 136 of the Education and Care Services National Regulations 2012 by failing to ensure that a staff member present held a first aid qualification.
A Department of Communities investigation found that on 20 January 2025, a 7-year-old child was left aboard a vehicle after returning from an excursion.
During the investigation, it was also revealed that a staff member failed to hold the required first aid qualification.
Amity Early Learning Pty Ltd was also ordered to pay $2,000 towards the Department's legal costs.
