Backing Workers' Long Service Leave Rights

The Albanese Labor Government is today introducing the Coal Mining Industry Long Service Leave (LSL) Legislation Amendment Bill 2025 to ensure workers in the black coal mining industry get the long service leave they have earned.

The Bill ensures eligible workers get their full entitlements, some dating back 15 years.

Under the arrangements, employers:

  • can opt in to voluntary payment arrangements with a two-month window once the provisions commence
  • have six years to pay historical arrears through instalments
  • will have 20% of their debt waived.

Employees will receive 100% of their long service leave entitlements.

The Coal LSL Scheme provides portable long service leave for eligible employees in the black coal mining industry, meaning entitlements move with workers when they change jobs within the industry. The scheme is funded by a levy on employers and ensures workers keep their entitlements even if they change employers.

It's expected workers in regions such as the Hunter Valley, Illawarra, Central Queensland, Mackay and the Whitsundays will benefit from these changes.

Minister for Employment and Workplace Relations Amanda Rishworth said the legislation would resolve long-standing issues around LSL entitlements.

"This ensures workers receive what they are owed, while supporting employers to meet their obligations in a sustainable way," Minister Rishworth said.

"Portable long service leave is critical for industries like coal mining where workers often move between employers. These changes strengthen the Coal Long Service Leave Scheme and make sure entitlements follow workers throughout their careers.

"The Government has worked closely with industry, unions and stakeholders to design a practical response to complex legacy issues. This legislation reflects that collaboration and our commitment to fairness for both employees and employers."
