Bayside Set for Preliminary Discovery Hearing

We have received notice that a date has been set for a preliminary discovery hearing in relation to legal proceedings concerning the Victorian Government's Activity Centres Program.

This is following on from the directions hearing that was held on 24 June 2026. Read the previous statement here.

The preliminary discovery hearing is the next step in this process to determine if Council is able to obtain and review relevant documents which justified the Ministers decision for bypassing normal public exhibition and notice requirements when making planning scheme amendments.

The Supreme Court has set a date for the hearing on 27 August.

We will continue to provide updates to the community when they arise.

Council remains committed to ensuring transparency and accountability in planning decisions that impact the Bayside community.
