Charges After Fatal Paint Factory Explosion

The 57-year-old man was killed and two other workers were seriously injured when a flammable liquid being decanted into drums ignited, causing an explosion and fire that engulfed the factory.

Indoc Pty Ltd faces a total of four charges under section 21(1) of the Occupational Health and Safety Act for failing to provide or maintain, so far as was reasonably practicable, a working environment that was safe and without risks to health.

It is alleged the company breached section 21(2)(c) of the OHS Act by failing to undertake an up-to-date hazardous area assessment and failing to eliminate non-intrinsically safe equipment from where flammable liquid transfer was occurring.

WorkSafe also alleges Indoc twice breached section 21(2)(a) of the OHS Act by failing to provide or maintain a safe system of work for the transfer of flammable liquids into drums.

It is further alleged the company breached section 21(2)(e) by failing to supervise workers to ensure earthing and bonding controls, and a spear or filling pipe were in place prior to the transfer of flammable liquids into drums.

The matter is listed for a filing hearing at Melbourne Magistrates' Court on 8 December 2025.
