Today, the Competition Bureau released its updated Abuse of Dominance Enforcement Guidelines.
The guidelines provide an overview of the Bureau's approach to enforcing the abuse of dominance provisions of the Competition Act.
In March 2018, the Bureau released a draft copy of the guidelines for public consultation. The Bureau reviewed comments carefully before finalizing the updated guidelines. The revised guidelines include various updates to the previous guidelines, such as:
- Enhanced guidance on how the Bureau assesses certain types of anti-competitive conduct;
- the Bureau's approach to assessing non-price effects on competition, dynamic competition and innovation;
- how the Bureau considers potential remedies; and
- examples that illustrate how Bureau analysis may be conducted.
The updated guidelines replace the previous guidelines dealing with these provisions.

Under the Act, abuse of dominance occurs when a dominant firm or group of firms in a market, engages in a practice of anti-competitive acts, with the result that competition has been or is likely to be lessened or prevented substantially.
