Court clears Vodafone/TPG merger in keenly awaited decision

The Federal Court has today ruled that the proposed merger between Vodafone Hutchison Australia Pty Limited (VHA) and TPG Telecom Limited (TPG) should be permitted to proceed.

The Court, in the biggest merger litigation in Australia in 10 years, found against the ACCC and held that the merger would not have the likely effect of substantially lessening competition.

Fiona Crosbie, Allens Chairman and lead Partner for VHA on the matter, said the decision was keenly awaited.

'We were so pleased to assist longstanding client VHA to secure the Court's blessing for what will be a transformative merger for the company and for the Australian telecommunications sector. We enjoyed working seamlessly with the VHA team to secure this expedited decision.'

The Allens team drew upon the expertise of senior litigator Chris Prestwich (Partner) and competition specialists Robert Walker (Partner) and Anita Thompson (Managing Associate).
