Lease of unused roads – for grazing or other agricultural purposes approved by Council

In accordance with Division 2 Sections 153-157 of the Roads Act, 1993 No 33, Council is considering the continuation of the leases of unused roads, as listed below, for a period of five (5) years commencing July 2023.

Snowy Monaro Regional Council is seeking Expressions of Interest (EOI) from adjoining land holders for the following vacant land and unused roads:

Conditions attached to the leases are as follows:

  • Only adjoining landowners may submit an Expression of Interest (EOI) for unused roads.
  • The term of the lease will be five (5) years commencing July 2023.
  • The subject land is to be used for grazing or other agricultural purposes approved by Council.
  • The lessee agrees to pay the annual rental in advance on a per annum basis.
  • For the referenced unused road sections, the lease is issued in accordance with the Roads Act 1993, Part 10 Division 2, Sections 153, 154, 155, 156 and 157.
  • The lessee must ensure that stock proof fences are in place between the leased land and any land not in the control of the lessee throughout the term of the lease. The lessee is responsible for maintaining all fences in a stock-proof condition throughout the duration of the lease. Note: The Lessee will be responsible for erecting boundary fences for the leased area, whether in existence prior or not, upon expiration of the lease.
  • The lessee is responsible for the eradication of weeds and pests.
  • The lessee is responsible for maintaining the level of vegetation to the satisfaction of the Rural Fire Service during bushfire season. Noting that any clearing requires prior consent from Council.
  • There can be no denial of public access.
  • The lease may be terminated by either party, by one (1) months' notice in writing.
  • The lease is only transferrable with prior consent from Council.
  • Should any dispute arise between landholders as a result of this lease then such lease will be cancelled.
