Fines for Renovation Flaws, Illegal Asbestos Removal

The Fremantle-based company (BC101639) were engaged to carry out building works which included removing walls, constructing new bathrooms, bedrooms and a powder room, and expanding living and wet areas.

According to information presented to the Board, investigations identified multiple building defects that posed a risk to the durability of the building and the safety of the occupants. These included handling of building materials, structural deficiencies, moisture and drainage issues, and substandard finishes.

Mr Bruce (BP14530) was fined $1,500 for failing, in his role as nominated supervisor, to properly manage and supervise the building work as required by the Building Services (Registration) Act 2011.

The company was fined $2,500 for the supervision failures and for negligent conduct because it arranged the removal of an asbestos ceiling without ensuring the subcontractor held a valid asbestos removal licence.

The Board has been advised that the home is free of asbestos, and a payment agreement has been reached between the homeowner and the company.

Building Commissioner Phil Payne said the Board's action reflected the importance of protecting homeowners and maintaining industry standards.

"Compliance with building standards and proper supervision are non-negotiable," Mr Payne said.

"This case highlights the importance of meeting building standards and maintaining proper oversight to ensure safety, quality and structural integrity. It should also remind building contractors about their responsibility for the work of subcontractors.

"Where these obligations are not met, enforcement action is taken to protect homeowners and uphold confidence in the industry."
