Canberrans who have suffered from food poisoning linked to a Kingston donut shop may have legal rights for redress, personal injury lawyer says.
Slater and Gordon Public Liability and Medical Law Principal Liam Casey said people affected may be entitled to compensation, particularly for pain and suffering, if they were struck down by food poisoning.
"Thankfully, most people who contract food poisoning are likely to make a full recovery and are not left with any permanent impairment, however, a claim can still be made for compensation even in those cases," he said.
"Food poisoning is an awful illness to experience and can lead to other related health complications. I have seen severe cases arising from previous outbreaks in the ACT where our clients have had lengthy periods of time off work and mounting medical expenses from ongoing symptoms."
Mr Casey said consumers would need to prove that they had contracted food poisoning from eating donuts from the shop under investigation by the ACT Health, such as providing a receipt of purchase, a bank statement or producing evidence of checking-in at the shop.
"I urge anyone affected by this outbreak firstly to seek urgent medical attention by visiting their GP," Mr Casey said.
"But if they suffered food poisoning and have incurred any out-of-pocket expenses such as medical bills and loss of income, for example, they should seek legal advice regarding whether a personal injury claim can be pursued."
