Today the President published a statement advising that the Fair Work Commission and the Fair Work Ombudsman (FWO) have established a new process for the FWO to refer any apparent ambiguities, uncertainties or errors in modern awards which the FWO has identified to us.
We are committed to ongoing collaboration to deliver more effectively our respective functions under the Fair Work Act 2009 to the Australian community.
We have developed a set of Guiding Principles to guide the process for the FWO to refer apparent ambiguities, uncertainties or errors in awards to us.
This statement outlines this arrangement, including the process by which we will consider any such referrals from the FWO. The statement confirms the process ensures we continue to exercise our award related functions independently and facilitates an open and transparent process for the consideration of any referral.
The process is set to start in the September quarter 2026 and is intended to be an annual process.
