Guarding Against Energy Market Misconduct

Give feedback on reforms that guard against energy market misconduct.

We are consulting on reforms to better prevent misconduct in Australian energy markets.

The Prohibiting Energy Market Misconduct (PEMM) Act came into effect in 2019. Earlier this year we looked into whether it is still effective.

Our final review report identified two ways to strengthen the PEMM requirements. Those are:

  • make the retail pricing rules stronger to protect customers when costs go up
  • not allow cross-market manipulation, such as across contacts and spot markets.

We invite stakeholders to comment on these proposals and other governance matters. These include which body is best placed to enforce the PEMM provisions.
