Logistics Firm Allegedly Dodges Unfair Dismissal Payout

The Fair Work Ombudsman has commenced legal action against a Brisbane-based transport and logistics company for allegedly failing to comply with a Fair Work Commission order to pay compensation to an unfairly dismissed worker.

Facing court is Gold Tiger Logistics Qld Pty Ltd, which is based in Archerfield.

The company employed the affected worker as a customer service and logistics co-ordinator.

The Fair Work Commission last year found that in September 2023 Gold Tiger Logistics Qld Pty Ltd had unfairly dismissed the worker, and in April 2024 ordered the company to pay the worker $32,000 compensation. The company subsequently appealed but was not successful.

The Fair Work Ombudsman alleges Gold Tiger Logistics Qld Pty Ltd has breached the Fair Work Act by failing to comply with the Commission order to make the compensation payment to the worker.

The Fair Work Ombudsman attempted to secure voluntary compliance but alleges that the compensation remains entirely unpaid.

Fair Work Ombudsman Anna Booth said the legal action would reinforce the importance of complying with Fair Work Commission orders.

"It is fundamental for the integrity of the workplace relations system that Fair Work Commission orders are complied with," Ms Booth said.

"The Fair Work Ombudsman will continue to take legal actions to ensure that employees receive all compensation they are lawfully entitled to."

For allegedly failing to comply with the Fair Work Commission order, Gold Tiger Logistics Qld Pty Ltd faces a penalty of up to $93,900.

The Fair Work Ombudsman is also seeking a court order for the company to pay the outstanding compensation owed to the employee, plus interest.

A directions hearing is listed in the Federal Circuit and Family Court in Brisbane on 9 March 2026.
