Notice to divest public walkways

The City of Darwin is proposing to dispose of the walkway between Abrahams Court and Hearne Court, Malak following requests from adjacent residents to purchase the land.

This walkway is currently under a night-time closure program arranged by City of Darwin.

In accordance with section 187 of the Local Government Act, Council is required to consult with the community prior to seeking approval from the Minister for Local Government to divest of public walkways.

Section 19 (3) of the Local Government Accounting Regulations provides as follows;

·Before a council submits for the Minister's consent a proposal to close a road in its area on a permanent basis, it must give public notice of the proposal.

·The notice must include an invitation to any person who may object to the proposal to lodge a written objection to the proposal within a reasonable period (at least 28 days) stated in the notice.

Should the Minister approve the sale of the public walkways, these will be offered for sale to each of the adjacent residents based the current market value of the land. With all costs associated to be paid by the proponent.

Public Feedback

City of Darwin is seeking feedback in relation to the disposal of the walkway between Abrahams Court and Hearne Court which is currently under a night-time closure program.

Please send any concerns or objections regarding this proposal to the City of Darwin by close of business 23 December 2022.
