We have issued an infringement notice of $18,780 to Victorian-based company, Nourishmeorganics Pty Ltd, for the alleged unlawful supply of a therapeutic good not entered in the Australian Register of Therapeutic Goods (ARTG).
Nourishmeorganics Pty Ltd paid the infringement notice earlier this month.
On several separate occasions between January and October 2024, Nourishmeoragnics imported Thorne Basic Prenatal capsules from New Zealand and supplied them to customers in Australia, in alleged contravention of the Therapeutic Goods Act 1989 (the Act).
The Act prohibits the supply of therapeutic goods unless the goods are entered in the ARTG, or subject to an exemption, approval or authority. Therapeutic goods not entered in the ARTG have not been assessed for their quality and safety by the TGA and may pose a health risk.
Individuals and businesses must ensure they comply with all regulatory requirements prior to the supply of therapeutic goods in Australia.
The TGA will take enforcement action where serious non-compliance with the Act is identified in accordance with our regulatory compliance framework. This may include issuing infringement notices, directions and prevention notices, or civil or criminal proceedings.
