The Office of the Australian Information Commissioner (OAIC) has today released a report of a Commissioner-initiated investigation into Property Lovers and fastproperty.ai , concluding that fastproperty.ai did not collect, use or disclose personal information.
The investigation concerned Property Lovers' ongoing compliance with a previous determination handed down by the Privacy Commissioner on 22 November 2024, which found that Property Lovers and another company owned by or linked to Kevin and Dominique Grubisa, Master Wealth Control t/a DG Institute, had scraped personal information to target vulnerable people in contravention of the Privacy Act 1988.
The report published today clarifies that, during the relevant period, the products and services offered by Property Lovers, under the fastproperty.ai platform, did not contain personal information.
"Ensuring and enforcing compliance with our determinations is an essential regulatory function of the OAIC, and an important mechanism for ensuring the privacy of the Australian community is protected. This comprehensive investigation has led me to conclude that Property Lovers were not in contravention of the Privacy Act during the relevant period," said the Privacy Commissioner, Carly Kind.
"However, during the course of the investigation, the OAIC received a number of reports relating to the acts and practices of Property Lovers, some of which were outside our jurisdiction. I continue to have concerns about the potential for ongoing harm to Australian consumers arising out of the claims that gave rise to this investigation, and as such, my office has provided details of these matters to the appropriate regulator for consideration."
