Here's why we oppose the Bill
The changes proposed by the Government in this Bill take rights from workers and give even more power to employers.
The changes effectively give employers the right to fire workers at will.
The Government is taking away:
- The right of workers who are successful in taking a PG to compensation if they contributed to the situation.
- The right of workers paid over $180k who are unjustifiably dismissed to take a PG and get compensation.
- The right of workers to sick, annual and bereavement leave and other statutory entitlements and protections if their employer (not the courts) decides they are a contractor and not an employee.
- The right of workers starting a new job where there's a collective agreement to be offered the terms of that collective agreement and get information about the union.
The Government is giving employers the power to:
- Fire someone for no justifiable reason if they earn over $180k
- Make the case that a worker should not get compensation, even when they're successful in a PG, because the worker has contributed to the situation.
- Have the final say about whether or not someone is a contractor or an employee with employment entitlements and protections.
- Not provide new workers with information about the union or the collective agreement at their workplace.
