Residential Land Reclassified from Community to Operational

Council has resolved to publicly exhibit a planning proposal to amend State Environmental Planning Policy (Precincts – Central River City) 2021 to reclassify a small area of land with an area of 487m2 at 28 Hynds Road, Box Hill (Lot 2 DP 621465) from 'community' to 'operational' land in accordance with the Local Government Act 1993.

The property at 28 Hynds Road, Box Hill was acquired by Council in May 2016. The majority of the property is zoned SP2 Local Drainage and was acquired by Council as it will form part of the future drainage network for the Box Hill Precinct. However, a small portion of the property (approximately 487m2, being around 2.4% of the total property area) is zoned R3 Medium Density Residential. At the time of purchase, the entire lot was acquired (both the SP2 and R3 land) and was classified as 'community' land under the Local Government Act 1993, which requires the land to be reserved for a public purpose specified in a Council plan of management.

The small residential-zoned portion of the land acquired by Council is surplus land, not required for the delivery of the Hynds Road Drainage Reserve and it was not intended that this land be reserved for a public purpose. Reclassification of the R3 Medium Density zoned portion of the land would enable its potential sale to the adjacent landowner. This potential sale would facilitate the construction of a planned local road link over this land (by the adjoining developer), as envisaged under the planning framework for the Box Hill Precinct. Accordingly, reclassification of the land would promote orderly development outcomes for the adjoining properties and assist in the completion of the road network for the wider Box Hill neighbourhood.

The reclassification proposal does not bind Council to any decision with respect to the future sale of the land (this would be the subject of a separate consideration and resolution by Council in the future if the reclassification proposal ultimately proceeds). However, it should be noted that if the sale of the land does ultimately occur, any proceeds from this sale would be accounted for as contributions income under Contributions Plan No. 15 – Box Hill Precinct, to be applied towards other infrastructure items identified under the Contributions Plan.

Following the completion of the public exhibition period, a public hearing will also be held with respect to this planning proposal and notification of this will be given on Council's News and Publications page 21 days prior to the date of the public hearing.

Council received a Gateway Determination for the planning proposal in February 2023. Delegation for making of the Local Environmental Plan has not been issued to Council under the Gateway Determination.

The planning proposal and supporting material is now on public exhibition and available for inspection on Council's website under Have Your Say (www.thehills.nsw.gov.au).
