Road Management Act must be followed

The City of Ballarat is a Road Authority and as such is governed by the Road Management Act 2004. This is State Government legislation which governs all Road Authorities in Victoria. All claims against Council which relate to roads, footpaths and other matters within the road reserve are managed by Council in accordance with this Act of parliament.

Section 110 (3) of the Road Management Act 2004 for example states "Limits in relation to liability for property damages, a road authority is not liable for property damages where the value of the damage is equal to or less than the threshold amount". The threshold, which is indexed annually, is currently $1,430.00.
