Construction Exec Charged with Duty Breach and Fraud

Recep Cevis, of Airport West, Victoria, has appeared in the Melbourne Magistrates Court charged with two counts of breaching his director's duties and one count of lodging a false and misleading document with ASIC.

Mr Cevis was the sole director of Cevis Holding Pty Ltd ACN 141 787 046 (In liquidation) (Cevis Holding) and RC Engineering Consultancy Pty Ltd ACN 160 505 537 (In liquidation) (RC Engineering) until they were wound up on 19 December 2022.

ASIC alleges shortly before the companies were wound up, Mr Cevis used his position as director of those companies to enter purchase agreements for two Mercedes Benz vehicles (one for each company), each valued at over $250,000. The cars were each purchased on finance, meaning each company took on debt which it did not have capacity to repay due to imminent liquidation.

ASIC also alleges that Mr Cevis made a false statement on a form lodged with ASIC while reporting on the assets and property of Cevis Holding. Mr Cevis failed to include in the report that Cevis Holding owned a Mercedes-Benz vehicle on finance from Mercedes-Benz Financial Services Australia Pty Ltd.

The matter was first heard at the Melbourne Magistrates' Court on 28 October 2025 for a Filing Hearing and was listed for committal mention on 20 January 2026.

The matter is being prosecuted by the Office of the Director of Public Prosecutions (Cth) (CDPP), following an ASIC referral.

Background

Mr Cevis was charged with two counts of breaching section 184(1) of the Corporations Act which carries a maximum penalty of 15 years' imprisonment and one count of breaching section 1308(2) of the Corporations Act, which carries a maximum penalty of five years' imprisonment.
