The NSW Environment Protection Authority (EPA) has fined a St Clair individual $30,000 for two alleged offences, after approximately 30 tonnes of building and demolition waste — including asbestos — was illegally dumped on public land in Badgerys Creek.
The waste was discovered in March 2025 on the nature strip of Elizabeth Drive. The EPA was alerted by the adjacent landowner and immediately launched an investigation.
EPA Director of Operations, Adam Gilligan, said officers were able to identify both the source of the waste and the individual responsible through detailed and timely investigative work.
"Our officers collected samples from around two semi-trailer loads worth of dumped waste and uncovered documents located in the material, which led us directly to a construction site in Leppington," Mr Gilligan said.
"The site operator had paid the individual to dispose of the waste lawfully, but instead he dumped it on public land—showing a blatant disregard for the environment."
"He admitted the offence to the site operator, after realising the EPA was investigating. This admission was supported by CCTV footage and phone records.
"Illegal dumping is a serious offence — especially when it involves asbestos, a known health risk. This was a deliberate and calculated act that put the community and environment at risk."
The EPA's investigation revealed the person responsible returned to the site five days later and removed the waste using a truck and a borrowed excavator.
"We've made multiple attempts to contact this individual, but he has failed to cooperate with our investigation and has failed to comply with a statutory notice to provide information and records," Mr Gilligan said.
"We'd like to thank everyone who has contributed to this investigation. Community reports and shared information are crucial in tackling illegal dumping and played a key role in achieving this outcome."
