Fair Work Commission Releases Draft Sexual Harassment Benchbook for Consultation

We are implementing changes to how we deal with sexual harassment disputes.

The Fair Work Legislation Amendment (Secure Jobs Better Pay) Act 2022 amends the Fair Work Act 2009. The amendments include new provisions that prohibit sexual harassment in connection with work. The amendments took effect on 6 March 2023.

Justice Hatcher, President, issued a statement dated 23 February 2023, with an Implementation Report, that discussed our expanded sexual harassment jurisdiction and how we plan to implement it.

As a step in implementing the changes, we have published a draft Sexual Harassment Disputes Benchbook for consultation.

We invite anyone interested to provide feedback on the draft Benchbook.
