On 19 June 2025 at Busselton Magistrates Court, the individual was also ordered to pay $350 in costs after pleading guilty to not complying with a Building Commissioner's order without a reasonable excuse. This is an offence under WA's building service complaint laws.
The person is not named because the court granted a spent conviction.
The court heard that the man installed a Colorbond boundary fence at a Dunsborough house in 2020, but around a year later it became apparent that numerous parts of the fence had been spray-painted in a way that did not meet the manufacturer's specifications.
The Building Commissioner issued a building remedy order requiring the man to replace all fence panels, posts, rails and aluminium slats that had been over-sprayed with paint.
While some remedial work was completed within the 28-day deadline, a follow-up inspection by Building and Energy found that spray paint remained on at least 10 posts, nine top rails, nine bottom rails and eight panel sheets.
The remedy order was later converted into a payment order for the full value of the fence. The man has since paid $2,400 to the homeowner.
"Failure to comply with a building remedy order is illegal and can cause significant stress for homeowners," Building Commissioner Peter Stewart said.
"Building service providers who do not follow through with their responsibilities, including rectifying their work, will face consequences."
