Former director charged with making false statement

Mr Zinan Ou of Beverley Park in New South Wales has been charged with making a false or misleading statement in a document lodged with ASIC. Breaching section 1308(2) of the Corporations Act carries a maximum penalty of 5 years' imprisonment.

Mr Ou was a former director of A-One Metal Services Pty Ltd (Deregistered) ACN 120 156 318 (A-One) which operated a metal and glass balustrading business.

ASIC's investigation found that on 7 May 2018, Mr Ou allegedly lodged a false and misleading document (Form 6010) with ASIC to voluntarily deregister A-One. In the document, Mr Ou claimed that A-One did not have any outstanding liabilities. It is alleged that, as at 7 May 2018, A-One had liabilities of more than $69,500 owed to creditors.

The matter was mentioned on 22 September 2020 in the Downing Centre Local Court and adjourned for further mention on 6 October 2020.

The matter is being prosecuted by the Commonwealth Director of Public Prosecutions.
