ICC Refers Tajikistan Non-compliance to State Assembly

The Presidency of the International Criminal Court ("ICC") has referred Pre-Trial Chamber II's "Finding under article 87(7) of the Rome Statute on the non-compliance by Tajikistan with the request by the Court to cooperate in the arrest and surrender of Vladimir Vladimirovich Putin and referral to the Assembly of States Parties", dated 19 March 2026, to the President of the Assembly of States Parties.

Pre-Trial Chamber II found Tajikistan failed to comply with its international obligations under the Statute by not executing the Court's request for the arrest and surrender of Mr Putin while he was on Tajikistan's territory. The Pre-Trial Chamber referred Tajikistan's non-compliance through the President of the Court to the Assembly of States Parties in accordance with regulation 109(4) of the Regulations of the Court.

In accordance with the Assembly procedures relating to non-cooperation, in resolution ICC-ASP/17/Res.5, annex II, paragraph 14 (c), a representative of Tajikistan was invited to the 6 May 2026 meeting of the Bureau of the Assembly to discuss the implications of the Court's decision regarding its non-cooperation and to present its views on how it would cooperate with the Court in the future.

Pursuant to paragraph 15 of the same annex, the Bureau will submit a report on the action taken, along with any recommendations, to the next session of the Assembly.
