Kings Forest Homeowners Get Faster Planning Approval

Kings Forest landowners can access streamlined approval pathways for eligible homes and exempt developments following a recent NSW Government planning decision.

A NSW Department of Planning, Housing and Infrastructure decision has opened the way for simpler and more streamlined approval options for eligible homes and minor development at Kings Forest.

The approval of MOD 11 to the Kings Forest Concept Approval (MP06_0318) means the Kings Forest Development Code is now formally recognised by the NSW Government, opening up Exempt and Complying Development pathways within the estate.

The change means eligible houses no longer need to go through the full Development Application (DA) process, provided they meet the relevant standards in Part A of the Kings Forest Development Code.

Instead, eligible house builds can now be assessed through the more streamlined Complying Development Certificate (CDC) pathway to get a quicker outcome.

Applicants can lodge a CDC with Council, or use a private accredited certifier.

Smaller works such as certain fences, decks, landscaping and minor outbuildings also benefit from the change. These minor, low-impact works that meet exempt development criteria will now be allowed without development consent or a Complying Development Certificate (CDC).

Council's Director Planning and Regulation Denise Galle said the decision marked another important step in bringing the long-planned Kings Forest community to life.

"Kings Forest has been more than 30 years in the making and will play an important role in delivering much-needed new housing for our growing community," Ms Galle said.

"Council welcomes the decision which will now allow eligible developments to use a simpler approval pathway while continuing to meet the standards established specifically for Kings Forest.

"This is a positive and practical next step following the registration of the estate's first residential lots, and reflects the ongoing collaboration between Council, the NSW Department of Planning, Housing and Infrastructure, the developer and other partners to support the responsible delivery of this new community," she said.

Other Council approvals may still be needed

Even if your home is eligible for a faster approval pathway, you may still need an approval from Council for associated infrastructure and works, including:

  • water connections
  • sewer connections
  • stormwater connections
  • driveway and road reserve works.

Council is reviewing how these associated processes can be coordinated to help provide landowners and applicants with a clear and efficient approval pathway.

Important considerations

Landowners should be aware that complying development is not an automatic approval pathway. A proposal must meet all applicable requirements of the Kings Forest Development Code and any other relevant legislative requirements.

Where a proposed development does not satisfy the complying development standards, a development application may be required. The application would need to be prepared and assessed in accordance with Part B of the Kings Forest Development Code.
