New listings

In accordance with section 15 of the Charter of the United Nations Act 1945 (COTUNA), the Minister for Foreign Affairs (the Minister) has listed three persons and one entity for targeted financial sanctions by legislative instrument (Charter of the United Nations (Listed Persons and Entities) Amendment (No. 1) Instrument 2026. In accordance with section 6 of COTUNA and relevant subordinate regulations, four new persons (under the UNSC 1591 Committee - Sudan framework) have also been added to the consolidated list, along with updates to the details of a number of existing listings.

Aliases for the abovementioned persons and entities are included in DFAT's Consolidated List.

Criteria

Grounds for listing persons, entities or assets

Listing for Resolution 1373

  1. The Minister must list a person or entity if the Minister is satisfied that the person or entity is a person or entity mentioned in paragraph 1 (c) of Resolution 1373.
  2. The Minister may list an asset, or class of asset, if the Minister is satisfied that the asset, or class of asset, is owned or controlled by a person or entity mentioned in paragraph 1 (c) of Resolution 1373.

Note: Paragraph 1 (c) of Resolution 1373 requires States to:

'Freeze without delay funds and other financial assets or economic resources of persons who commit, or attempt to commit, terrorist acts or participate in or facilitate the commission of terrorist acts; of entities owned or controlled directly or indirectly by such persons; and of persons and entities acting on behalf of, or at the direction of such persons and entities, including funds derived or generated from property owned or controlled directly or indirectly by such persons and associated persons and entities;'.

Listings under UN Security Council Sanctions Frameworks

COTUNA section 6 and the relevant subordinate regulations for each sanctions framework allow for new UN listings to be incorporated into Australian sanctions law. See the relevant sanctions framework page on the DFAT website for more details as to the effects of the listing.

Effects of listing

The effect of a listing under COTUNA Part 4 is as follows:

  1. any person holding a freezable asset' (including an asset that is owned or controlled by a listed person or entity) commits an offence if they, without the authorisation of the Minister, uses or deals with that asset, or allows it to be used or dealt with, or facilitates the use of or dealing with the asset; and
  2. any person who, directly or indirectly, makes an asset available to, or for the benefit of, a listed person or entity, without the authorisation of the Minister, commits an offence.

Application for revocation of a listing

A listed person or entity, or their authorised representative, may apply in writing to the Minister at any time to have the listing revoked. The application must set out the circumstances relied upon to justify the application.
