Outdoor smoking ban in NSW

With the changes to the Smoke-free Environment Act 2000 effective from July 6, smoking is banned in NSW commercial outdoor dining areas and within four metres of pedestrian access to hotels, clubs, restaurants and cafes.

Aimed at reducing staff and patrons’ being exposed to second-hand tobacco smoke, the bans applies to any ignited smoking product including cigarettes, pipes and  water-pipes while it is not illegal to use e-cigarettes.

Those caught in the act will be slapped with a $300 on the spot fine while businesses could be penalised $5,500 if they ignore the ban.

Although officials said inspectors would be enforcing the ban across the state, NSW Health confirmed proprietors and managers will also be required to stop people from smoking in smoke-free areas.
