The City of Casey is aware of ongoing community concerns regarding a property in Narre Warren North. It's important to note that these concerns fall under State Government planning controls and not Casey's Local Law.
The property is located in a Low Density Residential Zone, which is set by the State Government, and includes rules about how the land can be used and what types of uses are allowed.
Council clearly explained to the business owners, their rights and responsibilities when they enquired with us in 2014.
Following more community complaints in 2024, Council again offered options and explained how the business owners could comply with State Government planning laws. Despite being given ample time, the business owners ignored the advice and continued to operate without making any changes. A fine was then issued by Council to both land owners.
If the business owners chose to meet the requirements of the State Government laws for operating a business in a designated Low Density Residential Zone, then Council can look to waive the fines. However, if the owners believe they have not breached State planning laws, they can have the matter referred to the Magistrates Court for review.
